These Terms & Conditions ("Terms") govern the use and disclosure of confidential information by users of the Phybercare platform ("Platform"). By accessing or using the Platform, you agree to comply with these Terms.

 


 

1. Definition of Confidential Information

"Confidential Information" refers to any non-public information disclosed by Phybercare, its partners, affiliates, or users, including but not limited to:

  • Personal data, health records, or booking history.
  • Business strategies, pricing, financial data, and technical information.
  • Proprietary software, algorithms, and product development details.
  • Any other information designated as confidential by Phybercare.

 


 

2. Obligations of Users

Users agree to:

  • Maintain the confidentiality of any Confidential Information accessed through the Platform.
  • Use Confidential Information solely for the intended purpose of the Platform.
  • Not disclose, share, or disseminate any Confidential Information to third parties without explicit prior consent from Phybercare.
  • Implement reasonable security measures to prevent unauthorized access to Confidential Information.

 


 

3. Exclusions from Confidentiality Obligations

Confidentiality obligations do not apply to information that:

  • Is already publicly available without a breach of these Terms.
  • Is lawfully obtained from a third party without confidentiality restrictions.
  • Is required to be disclosed under applicable laws, regulations, or court orders, provided that prior notice (if legally permissible) is given to Phybercare.

 


 

4. Data Protection & Compliance

Phybercare complies with the Information Technology Act, 2000, and the applicable data protection laws of India. Users must adhere to all relevant laws, including but not limited to:

  • The Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.
  • Any future amendments or laws governing data confidentiality in India.

 


 

5. Breach of Confidentiality

Any unauthorized disclosure or misuse of Confidential Information may result in:

  • Legal action under applicable Indian laws.
  • Termination of access to the Platform.
  • Claims for damages or equitable relief, as necessary.

 


 

6. Retention & Destruction of Confidential Information

Users must:

  • Retain Confidential Information only for as long as necessary for the intended purpose.
  • Destroy or return any Confidential Information upon request by Phybercare or upon termination of their engagement with the Platform.

 


 

7. Modifications to These Terms

Phybercare reserves the right to modify these Terms at any time. Continued use of the Platform after modifications constitute acceptance of the revised Terms.

 


 

8. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in Karnataka, India.
